1. About these terms

These terms apply when you use the website pollysheldon.com or purchase any services from Brandesign Ltd (registered in England & Wales), with Polly Sheldon as director. By using this website or engaging my services, you agree to be bound by these terms.

2. Services

I offer the following services:

• Creative direction
• Brand photography (on-location and studio)
• Studio headshot sessions
• Brand identity design (logos, visual systems, brand guidelines)
• Website design and build
• Personal branding and LinkedIn optimisation
• Content creation and brand strategy

The specific scope, deliverables and timeline for your project will be confirmed in writing (via email or a formal proposal) before work begins.

3. Pricing and payment

• All prices are quoted in GBP and are exclusive of VAT unless stated otherwise.
• Payments are processed securely via Stripe. I do not store your card details.
• For larger projects, I may require a deposit (typically 50%) before work begins, with the balance due on completion or at an agreed milestone.
• For fixed-price services purchased through the website, payment is taken at the time of purchase.
• Invoices are payable within 14 days of issue unless otherwise agreed.

4. Intellectual property

What you own:

• Upon full payment, you receive ownership of the final deliverables — finished designs, edited photographs, website files and any other completed work products.
• You are free to use these deliverables for your business purposes without restriction.

What I retain:

• I retain the right to feature the work in my portfolio, on my website, social media and in marketing materials.
• I retain ownership of any preliminary concepts, unused designs and working files unless specifically agreed otherwise.
• Any tools, templates, frameworks or processes developed independently remain my intellectual property.

5. Photo usage rights

• For brand photography and headshots, you receive a licence to use the final edited images for personal and business purposes.
• I retain copyright of all photographs and the right to use them in my portfolio and marketing.
• If you require exclusive usage rights or wish to restrict portfolio use, this must be agreed in writing before the shoot and may incur additional fees.
• Images must not be altered, cropped or filtered in ways that misrepresent the original work without prior agreement.

6. Cancellation and refunds

• Before work begins: If you cancel before I have started work, you will receive a full refund of any deposit paid.
• Once work has started: If you cancel after work has begun, you will be charged for work completed up to that point. Any unused portion of the deposit may be refunded at my discretion.
• Photography sessions: Cancellations with less than 48 hours notice may forfeit the session fee or deposit.
• Digital products and completed services: Due to the nature of digital deliverables, refunds are not available once final files have been delivered.
• Rescheduling: I am happy to reschedule sessions and calls where possible, provided reasonable notice is given.

7. Your responsibilities

• Provide accurate information and materials needed for the project in a timely manner.
• Respond to feedback requests and approval stages within reasonable timeframes — delays may affect delivery dates.
• Ensure you have the right to use any content, images or materials you provide to me.

8. Limitation of liability

While I take great care in my work:

• My total liability for any claim arising from my services shall not exceed the total amount you have paid for the specific service in question.
• I am not liable for any indirect, consequential or incidental losses, including lost profits, lost data or business interruption.
• I am not responsible for delays caused by circumstances beyond my reasonable control.
• Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

9. Website use

• The content on this website is for general information and is provided in good faith.
• I reserve the right to update, change or remove content at any time without notice.
• You must not use this website in any way that is unlawful, harmful or fraudulent.

10. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these terms

I may update these terms from time to time. Any changes will be posted on this page with an updated date. Continued use of the website or services after changes are posted constitutes acceptance of the revised terms.
